Elder Abuse

Elder abuse is not merely physically harming an elder. It also occurs when anyone abuses, neglects, steals from or takes advantage of an elder. Unfortunately, it occurs more often than anyone would like to believe. Coercing an elder to do something he or she would not ordinarily do, can be elder abuse.

Examples of Elder Abuse

  • Persuading elders to give money to another without receiving anything of value in return.
  • Persuading elders to allow someone to continue to live in their home who regularly upsets them.
  • Isolating elders from friends and family members whom they want to see.
  • Forcing elders to live where they do not want to live.
  • Persuading elders to sign estate planning documents they do not understand.
  • Without prior court authorization, persuading elders to turn over management of their affairs before they need or want help.

Legal Help with Elder Abuse

Elder abuse is a crime. However, law enforcement is sometimes unable to help in situations where an elder is being taken advantage of by others. We have been able to help in situations where law enforcement could not collect enough evidence to proceed with a criminal action and in situations where an elder did not want to involve the police, but did need help with the situation. Many times, just knowing what legal rights are involved can be very empowering. We can help you determine if and when it's appropriate to call law enforcement and or obtain restraining orders. If you have any questions, please call, our communication is confidential, and if we cannot help you we can usually direct you to someone that can.
